Drug and alcohol abuse & the ADA

Article Abstract:

Drug use and alcoholism are protected disabilities under the Americans with Disabilities Act (ADA), so television and radio stations must make reasonable accommodations for such employees. Regarding alcohol use, stations may prohibit use at work and prohibit working while intoxicated, but termination of employees must be based on job performance. Drug use can be grounds for termination, but accommodations must be made for recovering users and users in treatment programs. Under the ADA, employment cannot be denied based on past use of drugs or alcohol.
