Proposal offers surveillance rules for the Internet

Article Abstract:

The administration plans to give Internet customers the same legal protections from electronic surveillance by law enforcement agencies as users of telephones and other forms of technology. The White House also proposes backing off export controls on encryption. The new privacy law is an amalgam of congressional Democratic and Republican proposals. The new regulations do not include the F.B.I.'s Carnivore system, which allows the government to take whatever information it wants, anywhere in cyberspace. EarthLink service provider has already been in court over Carnivore with the federal government. PSINet and other providers are also highly concerned over their customers privacy. Janet Reno plans to review these concerns.

A Boston federal appeals court surprises privacy advocates by ruling that federal wiretap laws do not apply to email messages stored on the computers of Internet service providers, even if those messages are only there for a fraction of a second while in transit.

Battle Brews on Regulation of Internet-Based Telephone Service

Article Abstract:

Small and large telephone companies are in disagreement on how much regulation is needed of Internet-based telephone service. The Federal Communications Commission's Michael Powell favors looser regulation than that governing traditional telephone services, but small Internet-telephone companies fear that reduced control by the states will allow large telecommunications firms to take them over, while state officials fear the destruction of their ability to fight consumer fraud and to ensure services in poorly-served areas.
