Cable, phone firms battle over open access

Article Abstract:

AT&T Corp won an important court case in its attempt to prevent municipalities from offering its cable network to competing Internet service providers. The 9th Circuit Court of Appeals ruled that Portland, OR, cable regulators cannot compel AT&T to offer access to competitors because high-speed Internet service is not a "cable service." The court, however, also ruled that AT&T's cable-modem service was a "telecommunications service" that is under federal laws that require telecommunications monopolies to provide access to their competitors.
