Microsoft appeal claims judicial bias

Article Abstract:

Microsoft Corp has asked an appeals court to overturn an earlier ruling ordering the breakup of the software giant. In its 150-page appeal of the antitrust case, the company claimed that Judge Thomas Penfield Jackson's decision to accept the government's breakup proposal after just one hearing undermines all confidence in the integrity of the proceedings. Jackson's conduct and the Washington appeals court's conservative leanings, thus, l ikely reduce the likelihood of a breakup.

Experts: Microsoft finding vulnerable to appeal

Paul Legal experts and knowledgeable sources said that Judge Thomas Penfield Jackson's decision that Microsoft exercises monopoly power can be questioned on several points. Microsoft can argue that Jackson failed to quantify how much of the market it allegedly monopolizes. Microsoft can also cite Jackson's admission that Microsoft's bundling of its Internet Explorer browser in Windows benefited consumers and improved the quality, while reducing costs, of Web browsing software.
