Court leaves no doubt: DOE obligated to take used fuel

Article Abstract:

The U.S. Court of Appeals has ordered the U.S. Dept. of Energy (DOE) to begin contracting for the disposal of used nuclear fuel, upholding the Jan. 1998 deadline. The DOE argues it needs a delay as it currently has no suitable facility, and that the court has no jurisdiction over contractual issues. Congress may approve the construction of an interim disposal site in Nevada.
