The after-acquired evidence defense: the unethical repercussions to employees

Article Abstract:

The Supreme Court ruled that the after-acquired evidence defense can no longer be used as a complete defense to protect employers from all liability. Despite this ruling, important unethical considerations still remain for employees in lawsuits against their employers. The after-acquired evidence defense uses a misconduct committed by an employee during the employee's tenure of employment as a ground for asking the court to reduce the damages an employer will pay an employee.
