The Threat of Age Discrimination Lawsuits has Increased in Recent Years but this Problem Can Be Avoided Through the Use of Outplacement and Staggered Severance

Article Abstract:

Between 1975 and 1985, the number of law suits involving the termination of personnel over the age of fifty and alleged discrimination on the basis of age more than tripled. The trends shows no signs of reversing itself, in fact, quite the opposite holds true. One solution involves a combination of generous, but staggered severance pay, designed to encourage the discharged employee to actually look for new work, and monitoring the seriousness of the job quest with the help of an outplacement firm, which reports back to the original company on a thirty-day basis. If the person is indeed in active pursuit of a new job, the outplacement firm suggests another monthly payment.
