Human rights in Africa: From communitarian values to utilitarian practice

Article Abstract:

The plausibility of the philosophical and political foundations of the African redefinition of human rights, which is based on traditional African collectivist values, is analyzed. It is concluded that the African theoretical interpretation of human rights may be politically justifiable but it fails to reconcile with global value of constitutionalist democracy and the traditional values of solidarity egalitarianism and an individuals dignity in the transitional African societies.

The possibility of secular human rights: Alan Gerwith and the Principle of Generic Consistency

Article Abstract:

A study explores Alan Gewirth's argument for a secular foundation for the idea of human rights as a possible to Michael J. Perry's claim of the idea of human rights as ineliminably religious, and considers his claims for the Principle of Generic Consistency. It concludes that if one is not troubled by charges of self-contradiction or one does not recognize that one's victim is as much a human being as oneself, Gerwith's theory will not seem particularly persuasive.
