The Appellate Body, the protection of the sea turtles and the technique of "completing the analysis"

Article Abstract:

US environmental regulations require that all shrimp trawl vessels equip their net with sea turtle excluder devices. These devices will prevent the drowning of sea turtles whenever they are caught in the shrimping boat's net. The US bans the importation of shrimp from countries or entities that do not comply with this regulation. However, certain Asian nations have requested the arbitration of the World Trade Organization as this move by the US may impinge on multilateral trade systems. The Appellate Body concluded that the US may have practiced unjustifiable discrimination against the Asian countries by evaluating another country's environmental programs against its own.

The appellate body and Harrowsmith Country Life

Article Abstract:

The Appellate Body of the World Trade Organization may have overstepped its authority and took on the function of dispute settlement panel in its ruling on the validity of taxation of split-run decision. This was made manifest in the appelate body's decision on the complaint filed by the US against Canada for imposing an 80% excise tax on split-run editions. The appellate body used the Harrowsmith Country Life case, the 1996 Japan-Alcoholic Beverage case and reports on the Canadian publishing industry in its ruling for the case.

Legal services and the Doha round dilemma

Article Abstract:

The article analyzes the connection between trade regulations and trade negotiations of the cross-border practice of law. This analysis helps policy-makers to formulate general global rules of trade and investment and most importantly solve Doha's multilateral political difficulties.
