The case against civil ex post facto laws

Article Abstract:

F.A. Hayek's observation that the negative impact of coercion can be reduced by informing people beforehand how they will be affected by coercive legislation is correct. Such laws should be known and definite to facilitate planning. As a result, criminal and ex post facto civil laws should be outlawed. However, only criminal laws have been prohibited. Such prohibition should be extended to cover civil laws. In addition, retroactive laws should be allowed only if the affected persons are justly compensated.
