Commercial real estate lending: the role of the federal banking regulatory agencies

Article Abstract:

A considerable exposure of lending institutions to non-performing commercial real estate loans due to relaxed underwriting standards coupled with the rapid decline in commercial real estate market conditions was the primary cause of the banking sector's financial crisis in the late 1980s and early 1990s. Federal regulatory agencies have since then increased monitoring activities on their respective commercial real estate lending sectors. However, these efforts continue to lack central coordination.

ADR: a rational alternative to unpredictable, time-consuming, and expensive litigation

Article Abstract:

American businesses have successfully utilized alternative dispute resolution (ADR) as a method for fast yet inexpensive settlement of legal disputes. Reports reveal a high percentage of cases that have been settled using ADR. Two of the most popular ADR techniques used are the mini-trial and mediation. These methods exhibit tremendous potentials in real estate financing applications.

Financing a regional mall: traditional sources versus securitization

Article Abstract:

Financing options include traditional financing and securitization. Whether one is to opt for traditional financing or securitization depends on the current pricing. Further, securitization also often involves more time and attention than the traditional one. Competition has lowered pricing and has given borrowers greater flexibility in arranging suitable financing for a project.
