Next round of base closures offers new brownfield redevelopment opportunities

Article Abstract:

The United States Department of Defense is identifying the bases and military facilities that will be suggested at the next base realignment and closure (BRAC) meeting at the end of 2005. Once the President and the Congress approve these bases, they will be offered to real estate developers for development and privatization. Closing military bases or brownfields as they are called are generally highly contaminated but the developers are not fazed as they now have better techniques at their disposal for environmental clean up and reuse the lands. Early transfer process related to the closing military bases under Section 120 of Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) are also discussed.

Real estate developers can register their business names on federal and state levels. They can also register the names of specific subdivisions and housing models to avoid trademark infringement.

It's Not Just Location: It's All in a Name!

Real estate developers who use a trademark or service mark are protected from others using the same name provided they are obtained under the federal statute known as the Lanham Act.
