LPA receivers tread a tightrope

Article Abstract:

The UK Law of Property Act empowers receivers to collects rents, recover income and make disposals. The issue of goodwill and whether receivers can continue to trade is complex and depends on interpretation of the legislation. A receiver could become personally liable if he does not act within the terms of the Act. Receivers have to study charges relating to their appointment, and lenders may seek to reassess terms of charge documents.

Keeping tabs on former tenants

Article Abstract:

Landlords wishing to serve notice on former tenants for sums which fell due before the introduction of the Landlord and Tenant (Covenants) Act 1995 have until June 30 1996 to do so. If a landlord fails to serve notice within six months of the sum being due, he will be unable to recover the sum. The subject is covered in Section 17 of the Act, and details of its application and definition of fixed charges are given.
