Disregarding works

Article Abstract:

In a case heard in the British High Courts the judge decided the tenant had played a part in the improvements which had been carried out by a third party and therefore they should be disregarded at a rent review. The tenant was renting 11 apartments on a lease lasting for 65 years which started in 1979. The tenant paid a third party to work on the apartments. In a rent review work carried out by the tenant is usually disregarded but there was a dispute between the tenant and landlord over whether the work should be automatically disregarded as its was not carried out by the tenant.

No good news on noise

Article Abstract:

Two cases heard in the UK House of Lords were brought by local authority tenants who claimed the landlords of their buildings had been a fault for letting the flats, despite the problem of noise from neighbours. The tenants claimed the noise caused a nuisance. The Lords felt the neighbour's noise was within reasonable limits therefore the problem of the landlord permitting the nuisance was irrelevant. The tenants also claimed the landlords' were in breach of the covenant for quiet enjoyment but the Lords pointed out the problem had been present when the tenants agreed the lease.
