Obstacles to victory

Article Abstract:

Landlords of retail outlets may claim breach of contract if the outlet ceases to trade and therefore the tenant fails to keep the obligation to stay open. A breach of contract may be incurred when a tenants fail to fulfill their obligation to continue trading and landlords may be awarded damages in compensation. In practice landlords face great difficulty in proving their losses were directly related to the breach of contract. Some contracts forgo the need prove the level of losses by having a liquidated damages clause which specifies the level of damages to be paid.
