Article Abstract:

The UK Civil Procedure Regulations 1999 enabled mediation to be used instead of litigation in disputes. Mediation has the advantage of giving clients the chance to work very closely with their solicitor on their cases. Mediation involves a mediator sitting down with the opposing clients and their legal representatives. The procedure takes less time than a court case and is less expensive. The majority of cases taken to mediation are resolved with both sides often having to compromise to reach a satisfactory outcome.

Clue up on technicalities

Article Abstract:

Landlords and tenants who use the law courts to resolve disputes concerning a technical infringement of a lease have often resulted in judgements being made against the party using a technicality to break, or change a lease agreement. Some landlords and tenants have tried to used the failure to comply with minor contractual clause to their advantage. The 1996 Access of Justice report recommends the introduction of a process of mediation for such cases, rather than the use of litigation.

Article Abstract:

The introduction of the new Civil Procedure Rules in Apr 1999 has led to a greater number of cases are being agreed outside the courts and therefore taking a shorter time. Yet there is some concern the system is more expensive and the changes may have been made without sufficient forethought. Alterations to the rules are still being made. Participants who fail to co-operate and work on discovering the issues of a case, before going to court, can be awarded costs sanctions.
