Good governance and the European Anti-Fraud Office

Article Abstract:

Office European de Lutte Anti-Fraude (OLAF) the European Anti-Fraud Office was set up to counter the problem of fraud and corruption within the European Union. OLAF is bound just as much as the Member States to comply with the standards set out in the European Convention on Human Rights (ECHR) and it is for the Court of Justice to ensure that, in the conduct of their affairs, OLAF adheres to this standard.

The article reviews developments in the case law of the Community Courts through 2005, particularly on issues of constitutional importance. Cases such as criminal law harmonization and international relations are increasingly complex and often difficult to settle judicially.
