Haunted by the past

Article Abstract:

The UK police carry out criminal record checks on job applicants only for certain categories of workers. This has prompted some employers to require applicants to obtain a copy of their criminal record under the provisions of the Data Protection Act. However, this record shows both spent and unspent convictions, and therefore goes against the safeguards established by the Rehabilitation of Offenders Act 1974. This act makes it illegal for an employer to discriminate against an applicant with a spent conviction, but a former offender has no way of enforcing this.

A workers' wish list?

Article Abstract:

There has been a generally very cool response to a report entitled 'Working Life: a new perspective on labour law' from the UK Institute of Employment Rights. This details recommendations for strengthening legal protection for workers and establishing minimum standards in the workplace. The Conservative and Labour parties have rejected the report, and even the TUC has not made a positive response. Other observers believe that the recommendations only appear radical because the UK is so far behind other countries in the area of workers' rights.

Abuse on the premises

Article Abstract:

The recent case of two black women who were subjected to racial and sexual abuse by comedian Bernard Manning when they were working as waitresses at a hotel where he was an after-dinner speaker has served to clarify the responsibility of UK employers in relation to protecting employees from racial harassment and abuse. The Commission for Racial Equality states that there is now a clear duty for the employer to protect employees from abuse, even if the abuse is being carried out by a third party.
