Article Abstract:

The UK government is to introduce a number of initiatives designed to unite the country's fragmented state bureaucracy, thus creating 'joined-up government.' New bodies such as the Cabinet Committee on Public Expenditure and the Social Exclusion Unit are designed to abolish departmentalism, and steps are being taken to ensure that policy formulation and delivery are monitored across government from a single central point. The Treasury has launched the 150 million pounds sterling Invest to Save Budget fund, designed to ensure that public services are delivered more coherently.

Contracting out - into trouble

Article Abstract:

The EC Acquired Rights Directive of 1977 guaranteed transferred employeesthe same rates of pay and conditions of service, but Compulsory Competitive Tendering (CCT) caused loss of these to many central and local government staff. The Transfer of Undertakings (Protection of Employment) Regulations of 1981 (TUPE) only covered commerce, and there is doubt whether CCT contracts are subject to it. The Employment Bill was published in Nov 1992 to correct the situation but the EC is still petitioning the European Court to ensure retrospective application.

Trying to make amends for regulatory errors

Article Abstract:

An Employment Appeals Tribunal in the case of Wren vs Eastbourne Borough Council on Jul 30, 1993 will probably dictate that public services contracted out to private companies can be liable to the European Community's Acquired Rights Directive. The rights of public service workers can affect contracting out in the NHS and market testing of civil service. The Trade Union Reform and Employment Rights Act (TURER,) which comes into effect on 30 Aug, 1993, may result in 10,000-25,000 court cases.
