The tort of outrage: how sexual harassment victims are fighting back

Article Abstract:

Sexual harassment law and remedies are being strengthened by court decisions allowing hybrid claims in tort and workers' compensation. By treating sexual harassment specially, courts are increasingly changing laws stipulating workers' compensation as the sole remedy for work-related damages, and allowing plaintiffs to pursue greater damages in cases involving outrageous conduct. Various state court opinions regarding sexual harassment and damage standards, including employer liability for employee actions, are surveyed.

Running the gauntlet no more: using Title IX to end student-to-student sexual harassment

Article Abstract:

Courts have been much less receptive to hostile environment sexual harassment claims in the schools than they have been toward such claims in the workplace. Most courts have said that schools are under no obligation to keep students free from the sexual harassment of other students, as long as boys and girls are treated equally. Continued harassment threatens the quality of education that girls receive. More must be done to ensure that they are free to learn and that the principles underlying Title IX are fulfilled.

Where are the civil rights for gay and lesbian teachers?

Article Abstract:

Gay, lesbian and bisexual teachers have been subject to attacks and dismissals in many jurisdictions because parents and administrators believe they are not fit to teach. Federal law provides little protection against sexual orientation discrimination. A minority of states that have statutes banning sexual orientation discrimination, and some of these statutes do not provide true equal protection. School boards have claimed that any disclosures by gay and lesbian teachers are efforts to promote homosexuality.
