Supreme court narrowly construes aliens' rights

Article Abstract:

The performance of the US Supreme Court has fallen short of expectations. Unlike in the past, the Court did not overrule any of the Attorney General's decisions. Furthermore, it has thoughtlessly interpreted aliens rights. It will take sometime to determine the impact of the Court's decisions on the adjudications by immigration judges, Immigration and Naturalization Service examiners, as well as asylum officers. Once more, Congress' immense influence on judiciary procedures has prevailed.

Immigration litigation update

Article Abstract:

Several recent federal court rulings involving immigration litigations are presented. They include a court granting attorney's fees to a Vietnamese alien after finding that the failure of an immigration judge to advise him of his right to designate a country of deportation constituted a reversible error, and a court ruling that permanent status is not required in determining when to begin computing years of unrelinquished domicile for Section 212(c) of the Immigration and Nationality Act.

Commission on Immigration Reform releases its final report: calls for Americanization and the breakup of the INS

Article Abstract:

The US Commission on Immigration Reform has given its final report to the US Congress on Sep 30, 1997. The report deals on the commission's recommendations to restructure the immigration system including the abolition of the Immigration and Naturalization Service (INS) as an agency. The commission has also recommended that INS' components parts should be dispersed to other federal departments. The restructuring of the immigration system is aimed at establishing a more reliable system.
