RICO conspiracy standing after Sedima

Article Abstract:

Standing should be recognized for individuals alleging that they were wrongfully discharged in connection with a RICO conspiracy. The ruling in Sedima SPRL v Imrex Co that standing must be associated with an underlying predicate act of the RICO statute should not apply to conspiracy charges. Conspiracy is a distinct crime which requires a different standing analysis. The Third Circuit ruling in Shearin v E.F. Hutton Group was therefore correct in finding that wrongful dismissal was an injury resulting from a RICO conspiracy.

How divided progressives might unite

Article Abstract:

Progressives in the US are fragmented, and often miss the opportunity to present a united front on important issues and during elections. However, unity could come about through work on a specific project to bring about a strong democracy and increased social control of economic issues.
