A lying shame

It is important to be aware that lying to a construction industry arbitrator can be just as serious an offence as committing perjury in a court. The Perjury Act applies to all courts and tribunals, and also covers people who by law can receive evidence on oath, as is the case with construction industry arbitrators. For this reason, it is vital to take the risk of perjury very seriously. Anyone acting as an expert witness should also take care not to express an opinion which they do not genuinely hold.

A little can mean a lot
Article Abstract:
On some occasions several events, coincidences or actions occurring together appear suspicious, even though they may not be noticed if they were viewed on an individual basis. The recent case of Lambeth and Botes in 1995, illustrates this point beautifully, when two directors of Botes Building were accused of fraudulent activity, after allegedly being involved in extorting money through overpayments and at least six other incidences of unusual practice. The case was never proven in court.

The tragedy of training
Article Abstract:
The Construction Industry Training Board is advised to change the way it funds its operation in a move to improve training. The Board currently charges employers per head for their subscription, and in the case of the self-employed, it charges a percentage of payments made. The case of Darren McDonnell is detailed in order to demonstrate the necessity for adequate training in the construction industry.
