Builders' contracts as good as you get
Article Abstract:
The ICE (Institute of Civil Engineers) Design and Construct Conditions of Contract 1992 is an ideal contract for employers when building work is to be carried out through a contractor. Employers's Requirements take precedence over the Contractor's Submission and the Employer's representative is allowed to issue certificates. Quality Assurance is covered. The Contractor has to provide a quality assurance system to be presented to the Employer's Representative for approval before work can be carried out. The Contractor will be compensated if the Employer's Representative fails to act within a reasonable period.

An estimate is not always an estimate
Article Abstract:
Estimates given by builders and others offering services may be regarded as quotations or offers. The definition of estimate as an offer was established by 1796 and was confirmed in law by the case of Crowshaw v Pritchard in 1899. Standard contracts include the term estimate and give it various meanings but the builder should be wary of its use and when providing an initial assessment of the cost of a job, should clearly state 'this is not an offer.'

Minor Works 1992 is vintage JCT
Article Abstract:
The 1992 Joint contracts Tribunal (JCT) Minor Works form of contract is an improvement on previous editions. The contract has been corrected in over 50 places and confusing terms and typography has been reduced. Amendment MW7:1991 has been incorporated and improved making the whole much easier to use.
