Maastricht cancels new liability term
Article Abstract:
The Construction Industry Specific Directive proposes Europe-wide liability harmonisation but could be made ineffectual by the Maastricht Treaty, which allows member states to introduce more stringent consumer protection measures. Directive proposals include creating a procedure for building 'acceptance' and commencing five-year liability from this date. A guarantee must also be obtained when work costs exceed limits established by the Commission and the member state for residential work. Companies would also be required to publish details of environmental and safety violations under the Disclosure of Safety and Environmental Information Bill.

Article Abstract:
A new European law, the Directive of the Posting of Workers, that aims to ensure foreign workers are treated the same as their counterparts, could have an affect on the competitiveness of UK contractors working in Europe. The directive is being delayed by disagreements among European Union members who oppose it, including Spain, Ireland and Greece. Member states have problems with many aspects of the directive, including its scope and the conditions applying to foreign workers. Details of the directive are presented.
