Transfer market update
Article Abstract:
A new interpretation was made of European legislation on the transfer of employees by the European Court of Justice when it ruled that the loss of a services-only contract to a competitor was not proof of the existence of a transfer under the Acquired Rights Directive. This ruling was taken into account when the UK Court of Appeal ruled in the Betts v Brintel case. This case implies that there will probably not be a relevant transfer under the Transfer of Undertakings rules unless there is a transfer of assets.
