Article Abstract:
Miguel Figueroa, a plumber in San Juan, PR, has sued the US government to stop Congress's diversion of fees from the Patent and Trademark Office (PTO) saying the lawsuit is on behalf of all who have paid fees to the PTO for patent applications or patents since 1991. Various mainstream organizations have the same point of view Figueroa has. He contends that the diversion of PTO funds amounts to direct taxation of intellectual property in violation of the US Constitution, Article I, Sec. 9. His complaint has two other parts. Rep Howard Coble (R-NC) suggests that appropriators should 'keep their grubby paws out of the PTO's coffers.' A group of US senators has written to the US president and declared support for reducing fee withholding from the PTO and urged that enough resources be provided for the PTO.
