Stress at work: statutory and common law duties of care
Article Abstract:
Employers in the United Kingdom have a statutory duty to ensure that working conditions are conducive to the physical and psychological health of employees. Although there is no law directly monitoring the area of job stress and employee mental well-being, this is covered by the Health and Safety at Work Act. Stress should be accounted for as a health hazard when the workplace plans are laid out. An employer can be held liable for an employee's mental or psychological illness if the employer has not taken reasonable care against foreseeable risks.
