Hospital Mergers and the Antitrust Laws: Major Roadblock or Minor Constraint?

Article Abstract:

Hospital mergers have increased to reduce costs and improve efficiency. The question whether antitrust laws apply to the health care industry is addressed. Private companies are using antitrust laws to prevent mergers between competitors. Antitrust enforcement sources include the Federal Trade Commission, the Department of Justice's Antitrust Division and private parties who bring suit. The Clayton Act, which forbids mergers that harm competition, is reviewed. Federal law concerning reporting requirements is detailed. Issues regarding the identification of illegal mergers, their impact, defining markets and measuring market share are outlined. Merger guidelines could increase health care costs rather than contain them. The health care industry has special characteristices that separate it from other industries.

Technology and products: FDA clears Group B Streptococcus test.

The US Food and Drug Administration (FDA) has cleared the IDI-Strep B test for commercialization in the US markets. The test detects around 94% of Group B Streptococcal infections in pregnant women accurately.
