AIDS and the insurer's right to rescind the insurance contract
Article Abstract:
The insurance industry has been faced with increased costs due to the AIDS epidemic and some insurers have reacted by rescinding health insurance contracts. The early age at which AIDS is typically contracted makes it difficult for the insurer's reserve fund to grow enough to avert losses. In addition, the insurance industry is not economically viable when there is a substantial likelihood for too many of the insured that the risk taken on will occur. Both factors militate in favor of removing the burden of AIDS treatment from private insurers and placing it in the public sector with tax funding.

Environmental insurance coverage litigation
Article Abstract:
There is no legally binding insurance coverage for deliberate, long-term pollution, as shown by the decision of In re Texas Eastern Transmission Corp PCB Contamination Insurance Coverage Litigation. The case was a total victory for the insurer, and it concerned $750 million in cleanup expenses. Some of the rulings in the case covered late notice, pollution exclusion, occurrence findings, damages findings, future claims and owned property findings.
