Beheading and blood money; Islamic legal system fair despite peculiarities, scholars say

Western public opinion say the punishments of beheading and 500 lashes meted out to British nurses Deborah Parry and Lucille McLauchlan by a Saudi Arabian court as draconian and barbaric, but Islamic law expert Frank Vogel feels that in a case which attracted so much worldwide public attention, confessions to murder are unlikely to have been extracted by torture. Judges in the Saudi system are seen as protectors of the wrongly accused. The victim and the family are the prosecutors in murder cases and can seek retaliation or forgive the crime and accept blood money.

Collecting their fees can be a problem for small practitioners and therefore written retainer agreements that detail both sides' expectations and obligations are a good idea. Including in these agreements a clause for late fees or interest on unpaid balances helps convey the lawyer's earnestness about obtaining fees. Sole practitioner Phillip Hurwitz includes in these clauses permission for him to charge clients late fees for fees or disbursements unpaid after 30 days.
