Article Abstract:
Employers must be careful not to use an approach which may give rise to claims of employment discrimination or unfair dismissal in dealing with incompetent or under-performing employees. British laws which speak to these issues include the Employment Rights Act 1996, the Sex Discrimination Act 1975, and the Disability Discrimination Act 1995. The Employment Rights Act 1996 states that incapability is a potentially fair reason for dismissal. Probationary periods for new or promoted employees can help reduce the risk of later poor performance.

No duty on employers to provide carers to attend to employees' personal needs
Article Abstract:
The Employment Appeals Tribunal ruled that the employer's duty under the United Kingdom's Disability Discrimination Act to make "reasonable adjustments" did not extend to providing an assistant to help a handicapped person use the toilet, even if the disabled person could not be employed without such assistance. The employer's duty is confined to making adjustments to the disabled person's work arrangements.
