Contract notions have corrupted torts
Article Abstract:
The dependence of tort law on contract theory has corrupted the field. Suggesting strict products liability is needed to increase consumer power is untrue. An injured plaintiff nearly always has the advantage at trial over an anonymous corporate manufacturer. Statistics show that strict liability has not made for a safer environment. It is fortunate that some thoughtful judicial opinions are recognizing that continued application of tort theory to products liability cases does not substitute for a reasoned risk-benefit balancing.
