Excerpts: Tenn. court rules in embryo case
Article Abstract:
Davis v Davis was the first state supreme court opinion on which party has the right to frozen embryos after a divorce. The trial court gave Ms. Davis custody, but the appellate court ruled that both of them should enjoy joint control as both possessed a vested interest. By this time Ms. Davis had remarried and wished to donate the embryos to another couple. The Tennessee Supreme Court agreed with the appellate court that the embryos were not persons under state law. The court held that the ex-spouses both had an interest in the nature of ownership, not a true property interest.

The life of a new associate at the prestigious law firm of Cravath, Swaine & Moore in the late 1960's was bound by tradition and custom. Little law was practised, the associates mostly performing research which would be altered slightly by a senior firm member to add a patina of originality. Success or failure were based as much on background as talent and insurance in the form of duplicate files was considered prudent. The view of life in business law is excerpted from 'Tombstones: A Lawyer's Tales from the Takeover Decades.'

The Office of Thrift Supervision (OTS) and the legal community have differing opinions as to the law firm Kaye Scholer Fierman Hays and Handler's degree of culpability in the savings and loan debacle. The OTS has imposed an executive freeze order on the assets of Kaye Scholer, former counsel to Lincoln Savings and Loan. Some attorneys feel this constitutes an attack on attorney-client confidentiality. Some in the legal community think the agency has overreached its authority by imposing a freeze without judicial review.
