Dispositive motions in arbitration proceedings
Article Abstract:
The American Arbitration Association (AAA) rules should be amended to allow for the use of dispositive motions. Parties should be allowed to make motions for dismissal or summary judgment. This will encourage prompt dispute resolution, as it will facilitate the resolution of threshold issues. Often the rest of the case may hinge on a threshold issue such as the arbitrability of the dispute.
