Real estate tax disputes: arbitration provides better resolutions
Article Abstract:
Arbitration is an effective way to solve disputes between property owners and government officials who asses the value of the property for tax purposes. Arbitration is less cumbersome than the appeal process involving government agencies. Legislators in several states, including Kansas, Texas, Georgia, West Virginia and Colorado, have written the arbitration option for real estate disputes into law. Arbitration techniques in real estate disputes are similar to the techniques for other disputes.

Commercial arbitration in Olde England (602-1698)
Article Abstract:
The 'loveday' in medieval England was an alternative to the litigation of 'lawdays,' with its own conciliatory rather than adjudicative processes. As the late Middle Ages flowered this process came under increasing pressure, partly from the commercial community it was designed to serve and partly from Parliament and the courts of law. Ultimately a Parliamentary act passed in 1698 forced a reevaluation of the roles of arbitration and litigation, and of who was to control each.

Vacatur: the non-statutory grounds for judicial review of commercial arbitration awards
Article Abstract:
Courts can vacate commercial arbitration awards under non-statutory grounds if the award demonstrates manifest disregard for the law or is contrary to public policy. Statutory grounds for revoking commercial arbitration awards are found in Section 10(a) of the Federal Arbitration Act. The section provides power to vacate awards in instances of corruption, fraud, partiality, misconduct or when arbitrators have exceeded their powers.
