"Useful life" has outlived its useful life: tax depreciation after Simon and Liddle
Article Abstract:
Two recent Tax Court decisions in the cases of Simon and Liddle have eliminated the useful life requirement for depreciation deductions. This result is sound and should be codified by Congress, although the decisions do not conform to the legislative history of depreciation under the Accelerated Cost Recovery System (ACRS). The elimination of the useful life requirement is also practical and consistent with general policy rationales for depreciation. Some assets that were previously not depreciable because they did not have determinable useful lives may become depreciable under the Simon-Liddle rule.
