Implied covenant law is still applicable in Texas, especially in relation to gas marketing duties of a lessee. Implied covenant law helps to balance the interests of lessees and lessors. Corporate law, antitrust law, class certification procedures, commercial law, and law and economics are relevant to the evaluation of implied covenant issues.
