S106 and its new appeal
Article Abstract:
It will shortly be possible to make an appeal to the UK secretary of state to change or discharge a planning obligation created under section 106 of the Town and Country Planning Act 1990. This right comes into effect after a period of five years has elapsed from the date of the obligation. It exists only as a right of appeal, and application must therefore first be made to the local planning authority.
