A medical trust fund for managed care: the legacy of Hughly vs Rocky Mountain Health Care Maintenance Organization
Article Abstract:
A Managed Care Medical Trust Fund could provide money to treat patients while their case is in mediation. Most patients will not receive treatment if the managed care plan disputes coverage. A Colorado woman with breast cancer sued her HMO when it refused to pay for bone marrow transplantation, which it considered experimental. The case was appealed to the Colorado Supreme Court, which ruled in her favor after her death. A trust fund financed partly by managed care plans could provide treatment funds in these cases.

Obligations and opportunities: the role of clinical societies in the ethics of managed care
Article Abstract:
Medical societies should do more to develop ethical standards for physicians in managed care organizations. The provision of ethical treatment is an obligation for anyone involved in a profession. The physician-patient relationship must be defended and it must be based on trust. The American College of Physicians will publish such guidelines in its ethics manual.
