Restraint reduction and legal risk management
Article Abstract:
The Nursing Home Quality Reform Act passed as part of the Omnibus Budget Reconciliation Act of 1987 and implemented by the federal Department of Health and Human Services. The law limits the use of physical and chemical restraints without proper clinical justification, documentation, and careful monitoring. Although the nursing home industry reacted favorably to the law, many experts contend the industry many face potential malpractice liability if nursing homes use restraints on those patients who are at risk of falling or wandering.
