The Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act: an unconstitutional deprivation of the right to privacy and substantive due process
Article Abstract:
Revisions could be made to the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act to address the constitutional infirmities inherent in the sex offender registration provisions. The law has been touted as a means of aiding law enforcement and has been justified based on high recidivism rates among sex offenders. The law's violation of privacy would be reduced by eliminating the community notification provisions. Procedural due process concerns could be satisfied by particularized findings being used to determine whether notification is warranted.

Article Abstract:
Voting and other political activity aimed at communicating with legislators will prove far more successful for the gay, lesbian and bisexual community than civil disobedience or other radical methods. The prospects for eliminating homophobia are promising. Many politicians have found that supporting gay and lesbian issues does not have adverse consequences at election time. Conventional political methods, which have proven successful for many other groups, should be used to further gay rights.
