Court upholds arrest of vessel

The New Zealand Court of Appeal upheld a lower court's decision regarding the case of Baltic Shipping Co. Ltd. vs. Pegasus Lines SA. The case involved a suit filed by the sub-time charterer for alleged negligent misstatement of the master list of the vessel's cargo capacity. Baltic Shipping Co. made an unsuccessful appeal to the High Court in Wellington before reaching the Court of Appeal. The Court decided that the claim in tort did not fall within the definition of admiralty jurisdiction under New Zealand's Admiralty Act of 1973.

Article Abstract:
Many European classification societies are considering mergers with the entry of new competition in the shipping industry and the decline in Far East trading. Diversification allows most class societies to increase revenues amidst declining markets while other classes have significant decrease especially in marine class work. These declines are pushing European societies toward increased cooperative ventures, alliances, mergers and even closer links with Asian class societies.
