Equal rights, equal wrongs

Article Abstract:

Proposals from the UK's Commission for Racial Equality (CRE) to reform the 1976 Race Relations Act are potentially injurious both to business and to race relations. The CRE proposes that firms with over 250 employees should monitor their workforce to ensure that it is ethnically representative. However, companies must employ staff according to their fitness for the job, the regulatory burden would have repercussions for staff and customers, and the proposal could lead to monitoring for other criteria. The proposal also comprises a fundamentally wrong shift in the burden of proof.

Who dares, loses

Article Abstract:

The UK government is undertaking a review of bankruptcy law, with Trade Secretary Stephen Byers having emphasized the importance of creating a climate in which responsible risk-taking is encouraged and the fear of failure is reduced. This approach has been widely welcomed, but it is important to be aware of the potential risks associated with changing the law in favour of the debtor rather than the creditor. The government must think very carefully before introducing the US's Chapter 11 procedures.

Russia: comrades in crime

Article Abstract:

Russia has vast potential for foreign investors, but only rates twentieth out of 40 emerging economies in a Control Risks/Industrial Research Bureau survey. Corruption is seen as central to business in Russia and organized crime has doubled since 1991, and looks set to increase. The Interior Ministry claims 8,000 organized crime syndicates were operating in Jun 1996, and 200 of these are involved in national operations. Shortcomings in the legal system pose major problems to overseas investors.
