AUSTRIA: LAWSUITS AGAINST MOBILKOM

Article Abstract:

The Austrian mobile phone service provider Mobilkom is being charged in two lawsuits initiated by the consumer organisation VKI. In the first case, Austria's Supreme Court held that the general standard terms and conditions of a company may be challenged in court even if they have been approved by the authorities. The clauses concerned in Mobilkom's contract have been amended in the meantime. However, the ruling may have wider ramifications e.g. for building societies which refer to the approval of their contract terms by the Finance Ministry. In the other lawsuit, VKI is challenging Mobilkom for charging Sch 30 for each payment from those clients who do not consent to direct debit, which is free of charge.
