Feasibility and admissibility of mob mentality defenses

Article Abstract:

Mob mentality has been proposed as an excuse defense and as a reason for failure to prove criminal intent or some other element of crime. The failure-of-proof defense is the more feasible of the two. However, the expert testimony needed to support a mob mentality defense should not be regarded as admissible. Such testimony would not be helpful to the jury in making findings on the facts of the case, and moreover it would be too general to be relevant to the particular defendants being tried.
