A certifiable nuisance

Article Abstract:

There are a number of reasons to be concerned about the UK Dept of the Environment, Transport and the Regions' consultation paper entitled 'Taking Forward Self-Certification Under the Building Regulations.' These include the concept of competency, with any organization certifying or approving a company or individual as competent to undertake certain work, or to self-certify compliance with the Building Regulations, becoming potentially vulnerable to being sued. Another problem area is the possibility that schemes could be accepted that allow individual operatives to self-certify.

Construction contractors should be aware of unfair guarantee agreements. The agreement issued for construction contractors, which are undertaking work for Birmingham city council, Birmingham, England, is too onerous and may lead to contractors agreeing to carry out repairs for up to 12 years.

Article Abstract:

A response to two articles by Judge Anthony Thornton which asserted that adjudicators are bound by the Human Rights Act is presented. The question of whether adjudicators are public bodies and subject to judicial review is examined.
