Article Abstract:

It is hard under UK law to allocate responsibility for a defect which appears in a building after completion if this defect seems to be the result of faulty design. Liability could rest with the design consultant, the contractor or the subcontractor, being determined by the provisions contained in the contracts and warranties according to which they undertook the work. It is vital to prepare contract documentation very carefully, thus avoiding a situation in which no party can be held liable for defects attributable to design faults.

UK construction consultants such as quantity surveyors and architects should give more attention to ensuring that clients are fully aware that project costs can be subject to considerable variation. In the case of an architect, liability may be incurred if negligent advice causes damaged to a client. Recent cases have clearly highlighted the need for consultants to take great care when preparing preliminary cost plans and specifications.
