Fla. marinas can't force evacuation, court says

The First District Court of Appeals in Tallahassee, FL, has ruled that Pensacola, FL-based dock facilities operator Mel's Marina cannot require his slip holders to move their boats out of the marina before a hurricane in rejecting its damage claims against 11 boaters. The boaters' vessels broke up the docks of Mel's Marina at the height of Hurricane Opal in 1995. A 1994 Florida law prohibits marina owners from ordering boats out if a hurricane watch or warning has been issued.

Independent contractor wins an injunction against marina

Article Abstract:

Marina interests across the US are monitoring the progress of a lawsuit brought on by an independent repair contractor against the 700-slip Marina Bay and parent Marinas USA Ltd in Massachusetts involving a state law rather than federal law. The central issue that the case has raised will affect all marina operators. This issue is the question of how far a marina can go in protecting itself against liability exposure without jeopardizing an outside technician's right to work.

Florida accord averts dock-building moratorium

Article Abstract:

The Army Corps of Engineers' decision to inform environmentalists of plans to issue project permits in manatee habitats has thwarted an immediate court-ordered moratorium on dock, marina and ramp construction in 16 Florida counties. Manatee advocates are seeking an injunction to stop all boat-related construction in the 16 counties while they litigate to require the Army Corps of Engineers to study the effect of boats and slips on manatees.
