Article Abstract:

The court case of Rackline vs the National Library of Wales illustrates the problems associated with subcontract promises. The National Library of Wales had promised shelving specialist Rackline that it would win a three million pounds sterling shelving subcontract, but main contractor Trafalgar postponed the shelving program until later in the contract, causing Rackline to increase its prices. While Rackline would have accepted the original subcontract, it was unwilling to amend its prices and the job was given to a competitor. The judge's ruling rejected Rackline's plea that the original promise should be kept.

Not the end of the world

Article Abstract:

The case of Crown Estates Commissioners v John Mowlem Construction Ltd. illustrates the problems associated with the JCT80 construction contract. In the case, John Mowlem was said by the clients to have failed to complete a construction job to their satisfaction and that, although they had isssued a final certificate, some of the workmanship was not to the architect's satisfaction, despite meetings to resolve the problem. The Appeal Court's ruling that a final certificate is proof of satisfactory work bars the clients from taking their case to arbitration. Details of the case are presented.

Article Abstract:

Issues surrounding litigation between builder Alfred McAlpine Construction and UNEX Group are discussed. The long-running case concerns an office block built by McAlpine. The complexity of the litigation is due to disputes over whether a company can sue for a third party's loss.
